1. Description of Service

This manually operated resort swap service facilitates the exchange of one week’s usage rights between qualifying timeshare owner-members at Kingswear Park Resort and Sutton Hall Resort.

Owner-members with ownership rights to a qualifying fixed-week unit can register it in the swap pool to exchange usage with another member who has registered at the other participating resort.

The resort administrators will manually match swap requests based on the registered unit details and member preferences before contacting them to check if both parties mutually agree to the proposed swap.

Once agreed by both owners, the swap will be confirmed, and reservation details provided to the respective resorts to enable access to the exchanged units for each owner. A facilitation fee of £75 will also apply to each member. Members do not give up their week until a swap is formally confirmed.

  1. Eligibility for Swap Registration

To register a unit week for inclusion in the manual swap pool, the following criteria must be met:

(a) You must have an ownership interest in either Kingswear Park Resort or Sutton Hall Resort.

(b) Ownership week must be a fixed week.

(c) All maintenance fee payments for the registered usage week must be duly paid up to date as per resort policies.

Weeks that meet these broad criteria may be registered for swap after owner consent.

  1. Registering Weeks

Eligible owner-members seeking to swap their registered weeks can submit their details through the online registration form or directly via email or phone to our Resort Swap administrators.

The following details constitute the minimum required data for registering qualified week units into the swap pool:

  • Name and Contact Information, including home address
  • Ownership resort
  • Unit Name and floor
  • Week Number and check-in date
  • Unit bedroom size
  • Which floor is the apartment located (ground or first)?

This data allows the administrators to accurately match other registered weeks from the reciprocal resort.

  1. Facilitation Fee

A non-refundable facilitation fee of £75 per successful exchange is payable by each swapping party for the administrative duties managed by the Resort Swap administrators. This includes matching suitable weeks, contacting owners to confirm mutual exchange consent after proposing an exchange, and conveying reservation details to resorts.

The exact fee amount of £75 is subject to review and may change in the future.

This facilitation fee must be paid within two days of confirming an agreed swap, failing which the swap match automatically expires, and availability is released into general resort inventory.

  1. Exchanging Weeks

During an exchange, usage rights for the underlying fixed ownership week rights get swapped between the two owners/parties. All other entitlements tied to ownership such as occupancy limits, resort amenities access, etc., will continue to be as per respective resorts’ applicable rules for owners and guests.

When an exchange match is proposed by the administrator via email or phone, owners at both ends must respond confirming their consent within two working days, failing which the match is automatically expired.

On receipt of confirmation to swap weeks from both owners, the administrator issues exchange confirmations containing the new reservation details for each party to enable access at the reciprocal resorts as swapped guests during the exchanged weeks.

If either party fails to arrive as per the confirmed reservation or cancels after issuance of confirmation, standard no-show or cancellation no-refund policies are issued.

  1. Exchange Limitations

Given overall unit inventories, exchange limitations may apply as follows:

(a) The maximum number of exchanges per registered ownership week could be restricted to two per calendar year.

(b) Secondary swaps (Owner A swaps with B, B swaps again with C, and so on) are prohibited.

  1. Liability

The Resort Swap administrators connected with this manual exchange programme merely serve as facilitators in matching potential swaps and confirming exchanges after consent from both parties.

They shall not be liable to either swapping party for any direct or indirect damages arising from:

  • Loss of rights due to one party failing to adhere to these terms and conditions.
  • Any consequential losses or damages suffered by users due to participation in the exchange program.

Usage rights and access during exchanged weeks will continue to be bound by existing terms and conditions of the respective resorts.  You are advised to check the website of the resort you are going to.

 

  1. Force Majeure: Neither party shall be liable for any failure or delay in the performance of its obligations hereunder caused by a Force Majeure Event, which shall mean any event beyond the reasonable control of such party, including but not limited to acts of God, war, terrorism, pandemic, fires, national emergencies, unavailability of transportation or utilities, or any other event that makes performance impossible, impracticable, or illegal.

You will be notified in writing of the Force Majeure Event and Resort Swaps will use reasonable efforts to mitigate its effects.

This clause shall not excuse non-performance caused by gross negligence, willfull misconduct, or intentional failure to comply with obligations. If any provision of this clause is invalid or unenforceable, the remaining provisions shall remain in full force and effect. This clause shall be governed by the laws of the United Kingdom.
